RESUMEN

          Estudiamos el fundamento de la obligación de la viuda de respetar el año de luto antes de contraer segundo o ulterior matrimonio. Estimamos que en la época arcaica, al fundamento religioso de respeto a los Manes del difunto, se añade la obligación de salvaguardar el carácter sagrado del vínculo matrimonial y la descendencia del pater familias como una muestra más de reverentia al fallecido. La legislación de Augusto y el cristianismo tendrán también su incidencia en esta obligación, tal como se analiza en los distintos textos.

ABSTRACT            

          We study the reasons for the widow's obligation to respect the tempus lugendi before getting second or subsequent marriage. We estimate that in the archaic to the religious basis of respect for the deceased Manes adds an obligation to respect and not to disturb the succession expectations of the paterfamilias. The legislation of Augustus and Christianity also have their impact on this obligation, as observed in texts.
