RESUMEN

          Antonio Díaz Bautista, Catedrático de Derecho Romano de la Universidad de Murcia, publicó entre 1979 y 1987 una serie de trabajos sobre las garantías personales y los negocios bancarios en la legislación de Justiniano. En el presente artículo se presentan los resultados de tales investigaciones entre las que resalta la obra Estudios sobre la banca bizantina publicado en Murcia, en 1987. En él se analizan los distintos contratos bancarios regulados en las Novelas de Justiniano y las innovaciones introducidas a petición de la corporación bancaria. Especial interés merecen las conclusiones a que el Autor llega sobre la kazara antifonesis y su identificación con el receptum argentari, supuestamente derogado –por desusado- por Justiniano en CJ 4.18.2.

ABSTRACT            

          Antonio Díaz Bautista, Roman law Professor at the University of Murcia (Spain), published between 1979 and 1987 a series of works about the personal guarantees and banking businesses in the legislation of Justinian. This article presents the results of such research among which stands out the monograph “Estudios sobre la banca bizantina” (Murcia, 1987). It discusses different bank contracts governed in the Justinian’s Novellae and the innovations introduced at the request of the banking corporation. Special interest deserves the conclusions that the Author reaches about the “kazara antifonesis” and its identification with the receptum argentarii, purportedly repealed -by deprecated - by Justinian in CJ 4.18.2.
