RESUMEN

          La porción legítima constituye una institución jurídica propia del Derecho de sucesiones que, en la configuración actual de los ordenamientos jurídicos pertenecientes a la familia romanística del Derecho, es el resultado de la fusión de dos instituciones precedentes: por un lado, la porción legítima romana; por otro, la reserva familiar germánica. Ambos ingredientes estuvieron presentes en la codificación francesa, la cual como en otras materias, sirvió de referencia a otros muchos ordenamientos jurídicos.

ABSTRACT            

          The legitimate share is a typical legal institution of succession law, in the current configuration of the laws pertaining to the roman family law is the result of the merger of two previous institutions: first, self-serving Roman; secondly, the Germanic family reserve. Both ingredients were present for the French codification, which as in other matters, he served as a reference for many other legal systems.
