THE CONNECTION EDICTA PRAETORIA-EDICTUM PROVINCIALE IN THE CHAPTER 85 OF LEX IRNITANA

RESUMEN

Es bien conocida la conexión edicta praetoria-edictum provinciale y así aparece en la Lex Irnitana cap. 85. Mi tesis es que las leyes municipales en Hispania fueron escritas more romano y fueron, fundamentalmente, leyes de control. La Lex Irnitana muestra la remisión al ius civile y, al mismo tiempo al ius honorarium seguida por todos los gobernadores provinciales lo que, en mi opinión, fue una poderoso instrumento de unificación juridica en el mundo antiguo. 

ABSTRACT            

          It is well known the connection edicta praetoria-edictum provinciale and so appear in the Lex Irnitana ch. 85. My thesis is that Spanish municipal laws were written more romano and essentially were laws of control.  The lex Irnitana shows the remission to the ius civile and at the same time the remission to the ius honorarium followed by all provincial governors, that in my opinion were a powerful instrument of juridical unification in the Ancient World.
