ABSTRACT

The praesumptio muciana, a complex Roman rule of law, the interpretation of which continues to be debated, survives only in Catalan law. Article 23 of the 1960 Compilation of the Special Civil Law of Catalonia retained the presumption, albeit with some changes, until the 1984 reform with the same structure and, apparently, the same purpose as in Roman law, where it had previously undergone a certain evolution.

KEY WORDS

Praesumptio muciana, Roman law, Catalan law, Compilation of the Special Civil Law of Catalonia of 1960, marriage, separation of property, donations between spouses.
