RESUMEN La regulación jurídica del mercado y de la feria comprende múltiples aspectos, tanto de Derecho Público como de Derecho Privado. En el presente trabajo, tras ofrecer una visión general de las ferias y mercados en las distintas regiones del Imperio, se analiza cronológicamente su regulación jurídica en Derecho Romano, para luego estudiar qué aspectos de dicha regulación fueron recibidos en el Derecho Español, con especial referencia a aspectos como la autorización para la celebración de los mercados, el confinamiento del comercio al lugar del mercado, la protección de los comerciantes o la pérdida del privilegio, en los que la recepción fue más intensa.
ABSTRACT Fairs and markets legal regulation includes many aspects, both of Public and Private Law. In this paper, after offering an overview of fairs and markets in the different regions of the Empire, it is chronologically analyzed their legal regulation in Roman Law, in order to consider which aspects of the above mentioned regulation were received in Spanish Law, with special reference to the authorization to hold markets, trade confinement to the market place, protection of traders or loss of the privilege, among other aspects, where the reception was more intense.
