ENTRE EL PASADO Y EL PRESENTE: EVOLUCIÓN HISTÓRICA DEL IUS SUFFRAGII Y EL IUS HONORUM, DEL DERECHO ROMANO AL DERECHO MEXICANO

BETWEEN THE PAST AND THE PRESENT: HISTORICAL EVOLUTION OF THE IUS SUFFRAGII AND THE IUS HONORUM, FROM ROMAN LAW TO MEXICAN LAW

RESUMEN         

          
          En el ejercicio de la profesión los abogados vemos que el derecho vigente es una evolución desde la ley de las XII Tablas hasta el Corpus iuris civilis, es decir, que el derecho romano se encuentra inmerso en la legislación actual y no somos los únicos. En efecto, una especialista, la Dra. Nelly Dora Louzan de Solimano coordinó una serie de estudios bajo el título El Procedimiento Civil Romano. Su vigencia en el Derecho argentino, haciendo un paralelo entre ambos (Buenos Aires, Editorial de Belgrano, 1981). En el mismo sentido María Elisa Camacho con relación a la cesión de Créditos en su obra “Cesión de créditos: del derecho romano al tráfico mercantil moderno” (Bogotá, Universidad Externado de Colombia, 2017). Después de una búsqueda exhaustiva de bibliografía, no hemos localizado trabajos donde se compare el derecho al voto en la legislación Romana, con igual facultad en el ordenamiento jurídico mexicano vigente, en consecuencia en el presente trabajo pretendemos hacer dicha comparación, analizando en primer término el derecho romano y en segundo lugar el mexicano, a fin de resaltar en las conclusiones, las similitudes que pudieran existir más allá de las divergencias propias de la diversa contextualidad histórica.

ABSTRACT                

          
                  In the exercise of the profession lawyers see that the current law is an evolution from the law of the XII Tables to the Corpus iuris civilis, that is, that Roman law is immersed in the current legislation and we are not the only ones, in fact, a specialist, Dr. Nelly Dora Louzan de Solimano coordinated a series of studies under the title The Roman Civil Procedure Its validity in the Argentine Law, making a parallel between both. In the same vein Maria Elisa Camacho in relation to the assignment of Credits in his work "Assignment of credits: from Roman law to modern merchant traffic". After an exhaustive search of bibliography, we have not located works where the right to vote is compared in the Roman legislation, with equal faculty in the current Mexican legal system, consequently in the present work we intend to make this comparison, analyzing in the first place the Roman law and secondly, the Mexican, in order to highlight in the conclusions, the similarities that could exist beyond the divergences of the diverse historical contextuality.
