THE PRESENT OF THE PAST: THE PRINCIPLE MATER SEMPER CERTA EST AND ITS REFLECTION IN THE CURRENT LEGISLATION ON HUMAN ASSISTED REPRODUCTION

RESUMEN         

          
          El presente trabajo presenta un análisis que parte de la problemática de la determinación de la filiación en Roma y su evolución hasta nuestros días. En concreto, se centra en la evolución del principio romano mater semper certa est atribuido al jurista Paulo y su mantenimiento en la sociedad actual en la que se evidencian dos ámbitos de constante cambio como lo son el de la familia y el de la medicina. Los nuevos modelos familiares y las nuevas técnicas de reproducción humana asistida condicionan una nueva realidad social en la cual se plantean incluso supuestos de doble filiación por maternidad impensables en época romana y que producen el replanteamiento del citado principio de Paulo.

  

ABSTRACT                

          
                  This paper presents an analysis of the problematic determination of parentage in Rome and its development until today. Specifically focuses on the evolution of mater semper certa est roman principle attributed to the jurist Paulus and maintenance in today’s society in which revealed two areas of constantly changing as are the family and medicine. The new family models and new techniques of human assisted reproduction condition a new social reality in which cases arise even double-descent maternity unthinkable in Roman times and produce a rethinking of the principle of Paulus.
