RETENTION OF POSSESSION AGREEMENT IN THE CONTRACT OF SALE.

RESUMEN
Este artículo analiza un pacto que aparece a veces en la práctica diaria
según el cual el vendedor puede retener la posesión, mientras que la propiedad
queda inmediatamente transmitida al comprador, tratando de delimitarlo con la
ayuda de las fuentes y conceptos procedentes del Derecho Romano; así como los
efectos del mismo entre las partes y frente a terceros.
ABSTRACT
This article analyses an
agreement that appears from time to time in daily practice according to which
the seller can withhold the possession of the asset while property is
immediately transferred to the buyer, trying to determine it with the aid of
Roman Law sources and concepts; as well as its effects between contracting and
third parties.
