LA IMPOSIBILIDAD DE LA ACEPTACIÓN PARCIAL DE LA HERENCIA EN UN RESCRIPTO DE JUSTINIANO
THE IMPOSSIBILITY OF THE PARTIAL ACCEPTANCE OF THE INHERITANCE IN A JUSTINIAN’S RESCRIPT

RESUMEN De entre los requisitos que han de cumplir la aceptación y la repudiación de la herencia romana se halla la exigencia de que en ambos casos la declaración de voluntad del heredero ha de ser plena, es decir, ha de referirse a la totalidad, porque son inadmisibles las aceptaciones y las repudiaciones parciales. Teniendo presente el derecho clásico, Justiniano utilizó como ratio decidendi el aforismo vel omnia admittantur, vel omnia repudientur a la hora de resolver la consulta planteada por el Prefecto del Pretorio Juan entorno a la dudas surgidas en dos casos distintos de sucesión testamentaria, en los que debía determinarse la necesidad y el alcance de la aceptación de la herencia. El análisis de la constitución y la determinación de su fundamento en el ámbito del derecho hereditario romano son los objetivos que nos hemos propuesto en éste trabajo.
ABSTRACT Among the requirements to be met by the acceptance and repudiation of the Roman heritage is the requirement that both the declaration of will of the heir has to be full, ie must refer to the whole,why are inadmissible acceptances and partial repudiations. Bearing in minid the classical law, Justinian used as the aphorism level ratio decidendi omnia admittantur, vel omnia repudientur to solving the query raised by the Praetorian Prefect Juan around the doubts raised in two separate cases of probate, in which should determine the need and scope of the acceptance of inheritance. The analysis of the constitution and the determination of the merits in the field of Roman inheritance law aret the goals we have proposed in this work.
